Terms & Conditions - GCC


By Registering on the Club Apparel Mobile App, you accept the terms and conditions of Club Apparel – the Loyalty program of Apparel Group (comprising of Apparel LLC, Montreal Trading LLC, Shoe Plaza LLC, Dynamic Fashion LLC, AGI General Trading LLC, Miraqe General Trading LLC, Apparel General Trading). Apparel Group reserves the right to amend, cancel or change the terms and conditions or suspend the loyalty program at any time without any notice and Apparel Group has the sole discretion on the same. The terms and conditions of Club Apparel Loyalty Program herein referred to as “Club Apparel” are listed below
1. The Club Apparel membership commences when the customer registers into the program using the mobile application validating the account with One Time Password and providing the Date of Birth along with setting up the password
2. The membership is valid for a period of one (1) year from the date of joining the program. At least one purchase in a year is a prerequisite for successive renewal of membership
3. Apparel group reserves the right to terminate any membership without any notice at its sole discretion. Any discontinuance of membership does not limit Apparel Group’s right to use information / data collected on members during the term of membership
4. This program is applicable across all approved participating retail stores of the Apparel Group and its partners
5. Only one (1) membership per GSM phone number.
6. The membership is non-transferable and can only be used by the authenticated / validated member. Customer needs to complete successful OTP validation on the registered number to complete authentication
7. Membership charges and term of membership, if any, will be decided by Apparel Group at its sole discretion
8. Club Apparel members are entitled to earn points on purchase of any regular priced merchandise, or what is otherwise announced by Apparel Group
9. A valid point is equivalent to one (1) Arab Emirates Dirham. Customer accessing the app from Kingdom of Saudi Arabia, Qatar, Kuwait, Oman and Bahrain will receive their currency equivalent benefit in respective countries
10. Points can only be earned / redeemed through the Mobile App only. To redeem points, customer must complete their profile on the Club Apparel Mobile App
11. CA Points are valid for redemption within one year from the date of purchase
12. Brand Points validity is decided by Club Apparel while rewarding the points; the point’s expiry date can be checked on mobile app
13. Points earning structure may vary from brand to brand and format to format. For latest point earned structure kindly refer the Club Apparel Mobile App
14. Points earned on full priced products versus sale / promotion products may vary
15. Members can earn points while redeeming Apparel Gift Cards. Points are not issued upon purchase of Apparel Gift Card
16. Points are issued on the Nett tendered amount in Cash / Credit Card / Debit Card excluding the VAT amount. Example, points are not issued on promotional gift vouchers amount
17. Apparel Group may at any time reject to reward or redeem points for failure to pay for the purchases or for any breach of these conditions or for any judicious reason and the member shall have no right to claim the points
18. Points cannot be transferred between member accounts. However, a member can change the number by editing the number on the mobile app and re-validating the same
19. Points can never be exchanged or transferred to cash but can only be claimed against purchases in Club Apparel participating stores
20. Apparel Group will deduct points at the time of refund if any awarded-on purchase
21. All points belong to Apparel Group and may never be exchanged for goods not approved by Apparel Group
22. Membership rights are reserved with Apparel Group and are subject to Apparel Group's approval. A membership can be terminated in the event of a member failing to comply with these Terms & Conditions or supplying any false or misleading information to Apparel Group or abusing any membership privileges or not using membership for a period of 12 months or in case of death of a member or becoming bankrupt or under discretion of Apparel Group for judicious reasons
23. A member may cancel his / her membership by giving Apparel Group written cancellation request through email at clubapparel@appareluae.com
24. In case of such termination Apparel Group shall be responsible to the member only to the extent of the points lying to the credit of the member's account
25. Apparel Group shall not be responsible whatsoever for any data loss, or corruption of data or its confidentiality or the likes of the customer. No claim of whatever nature in this regard, shall lie against Apparel Group either by the customer or a third party
26. Apparel Group also does not take responsibility for any lost points / discrepancy of points earned or any claim for damage to a mobile phone as a consequence of a Club Apparel membership
27. Apparel Group shall not be held liable for any loss, theft, damage or unauthorized use of the mobile phones/membership/mobile app account and it is the sole responsibility of the member to ensure safety of his mobile phone, mobile app account and/or the password if any allotted to him for the purpose
28. Any loss of mobile or sim card should be intimated to Apparel Group immediately failing which member is liable for loss of points and will not hold Apparel Group for any loss occurring due to such events
29. All conditions and warranties, whether expressed or implied and whether arising under legislation or otherwise, as to condition, suitability, quality, fitness or safety of any reward supplied are expressly excluded to the full extent permitted by law. Any liability that cannot be fully excluded is limited, where permitted, to replacing, or crediting the value of the Loyalty points at our discretion
30. Apparel Group shall not be responsible in any way for technical faults by third parties and service provider as they are beyond the control of Apparel Group. Apparel Group shall at the best shall endeavor to sort out the said problem

Decision of Apparel Group on all matters of this membership shall be final and binding on the parties.
This shall be governed by the GCC laws and the courts of Dubai shall have exclusive Jurisdiction.

Terms & Conditions – 6th Street - GCC  

1. Member(s) refers to user(s) of Club Apparel Application and its services which includes other persons participating along with the Member in using the Services.
2. Purchase refers to any Order placed by the Member on 6thStreet across all the available channels such as but not limited to the 6thStreet Mobile Application, 6thStreet Website etc.
3. Member can earn & redeem points, on purchases made across all the available channels of 6thStreet such as but not limited to the 6thStreet Mobile Application, 6thStreet Website etc. , this is subject to the Terms and Conditions of 6thStreet & Club Apparel.
4. Member can earn & redeem points on purchases made on 6thStreet only when they link their Club Apparel account to their 6thStreet account. For more details regarding linking of Club Apparel Account to 6thStreet Account kindly refer 6thStreet FAQ.
5. A Member can link only One Club Apparel Account to their 6thStreet account at a time.
6. For any purchase made by the Member, points are accrued item wise as and when the items are delivered to the Member.
7. Members must ensure that they have completed their profile on the Club Apparel Mobile Application to redeem Points while purchasing on 6thStreet.
8. Club Apparel Points will automatically be debited from the Member’s Club Apparel Account at the time of redemption while purchasing on 6thStreet.
9. In case of Returned purchases which were paid for using Club Apparel points completely/partially, the Club Apparel points will be credited back to the Member’s Club Apparel account after debiting Points equivalent value of Cash on Delivery Charges (if any) and/or Shipping Charges (if any). Member agrees to such deductions of Charges that may change from time to time.
10. Points redeemed on an Order that has been cancelled will be credited back to the Member’s Club Apparel account.

15. Members cannot redeem their Club Apparel points partially; all the currently available Club Apparel points will be used for redemption first while placing an Order on 6thStreet.
16. In case the Member changes their phone number on the Club Apparel Application, the same will reflect in their 6thStreet account (only in case both Club Apparel & 6thSteet accounts of the Member are linked).
17. By placing an order on 6thStreet linked to their Club Apparel Account, Member agrees to all terms & conditions including privacy policy of Club Apparel & 6thStreet including sharing Member’s details with their subsidiaries, Partners, platform service providers, marketing service providers etc. in order to provide a seamless experience to the Member. Member indemnifies Club Apparel & 6thStreet, their subsidiaries, Partners, platform service providers, marketing service providers etc. for any usage of Member’s details by these entities to provide seamless experience to Member at the time of the Order and subsequently thereof to provide Member with information on new offers/products/features/brands etc. to enhance the Member’s overall experience with Club Apparel & 6thStreet. Club Apparel & 6thStreet, their subsidiaries, Partners, platform service providers, marketing service providers etc. reserves the right to analyse, interpret, use Member generated data both personal and generic to create a better experience on Club Apparel &6thStreet platform.
18. Member agrees to indemnify and hold Club Apparel, 6th Street their parents, subsidiaries and affiliates, agents, officers, directors, or other employees harmless from any claim, demand, or damage (whether direct, indirect, or consequential), including reasonable attorneys' fees, made by anyone in connection with Member’s use of the site, with Member’s submissions, with any alleged infringement of intellectual property or other right of any person or entity relating to the Application, Member’s violation of these Terms of Use, and any other acts or omissions relating to the site.
19. Club Apparel reserves the right to suspend/discontinue the program without notice, make modifications and alterations in any or all its contents, products and services contained on the Application.
20. The Member agrees that for any issues related to Order on 6thStreet which could be and not limited to Product, Service, Delivery, Payments, Refunds, Cancellation etc. the Member will connect with 6thStreet and understands that Club Apparel does not play any role with 6thStreet operations including sale and delivery of products from 6thStreet.
21. In relation to any returns, the terms of product return belonging to 6thStreet are applied. Club Apparel does not undertake any responsibilities for the disputes, which may arise from terms of product return belonging to 6thStreet.
22. Club Apparel shall not be liable for any issues related to quality of service, wrong delivery of order, order mismatch, poor quality, incorrect pricing, time taken to deliver the order, etc.
23. Club Apparel shall not be liable for any direct, indirect, special or consequential losses or damages from the use or inability to use this App. Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence.
24. Member agrees to indemnify and hold Club Apparel, its parents, subsidiaries or employees harmless from any claim, demand, or damage, including attorneys' fees, made by anyone in connection with the Member’s use of the App, with any alleged infringement of intellectual property or other right of any person or entity relating to the site, Member’s violation of these Terms of Use, and any other acts or omissions relating to the site.
25. To the extent permitted by law, CA provides this App, its features and integrations with 6thStreet and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of this site, or that it will be timely or error-free, that defects will be corrected, or that the site or server that makes it available are free of viruses or other harmful components. Subject to the previous paragraph, neither Club Apparel nor Club Apparel directors, officers, agents, employees or contractors shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this site. Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence or that of our agents or employees.

Terms & Conditions – #Foodie  

1. Member(s) refers to user(s) of Club Apparel Application and its services which includes other persons participating along with the Member in using the Services.
2. "User" refers to you, as a user of the Services. A user is one who accesses the Services for displaying, transacting, or uploading information and includes other persons participating along with the “User” in using the Services.
3. “Delivery Partner” refers to the delivery service provider selected by Partner Restaurant responsible for carrying and delivering the User’s order from the Partner Restaurant to the Delivery Address entered by the User on Club Apparel Application. Various Partner Restaurants will have different Delivery Partners depending on the Restaurant location and delivery area of the Restaurant. Delivery Partners enter into a direct contract with the Partner Restaurant.
4. Club Apparel is a platform to connect Users with Partner Restaurants allowing Users to order items for delivery and pickup. When User orders from a Partner Restaurant, Club Apparel Application communicates the order to Partner Restaurant for them to complete the User’s order and to manage the experience throughout the order process. By ordering through Club Apparel Application User enters into a direct contract with the Partner Restaurant for respective delivery / pickup of orders. The User indemnifies Club Apparel for any lack of quality, quantity and service provided by the Partner Restaurants & Delivery Partners. The User also indemnifies for any food allergies and related complications that may arise by consuming the food ordered through Club Apparel Application from its Partner Restaurants. Club Apparel is in no way responsible for the contents of the order.
5. Each Partner Restaurant has a fixed delivery area, please note the delivery area may change at any time. Partner Restaurants decide their own operating hours, which means that the availability of our service, and the range of Partner Restaurants from which the User can order, depends on the Partner Restaurants in the User’s area.
6. Upon placing an order through our App, it needs to be accepted by the Partner Restaurant. A notification will be sent to the User if the order has been accepted.
7. For placing an order, User will have to provide certain details like contact number and delivery address etc. User needs to take particular care when providing these details and needs to ensure the accuracy at the time of placing an Order.
8. User must prepay for all items ordered using their account, and for related delivery charges, even if they have ordered the item for someone else.
9. Please note that our Partner Restaurants may operate a minimum order value policy which might differ for different Partner Restaurants and Delivery Areas.
10. Certain products may have allergens like nuts, dairy etc.; the user can view the same in our App, if provided, while placing an order. User should contact our Partner Restaurant prior to ordering if they have any allergy. User must pre ensure that they do not order any items that they are allergic from and must directly inform the Partner Restaurant about any prevailing allergies that they may want to avoid. User is accountable and responsible for ascertaining with the Partner Restaurants that the User is not ordering / consuming any item that may cause any allergies to the User or violates any dietary restrictions of the User
11. Some of the products listed may be suitable for certain ages only. User should check the product they are ordering and read its description, if provided, while placing the order. User must ensure that they are an adult and are legally authorized to order on Club Apparel application. By ordering on Club Apparel App the User confirms that they are an Adult and accept all Terms & Conditions of Club Apparel and its Partner Restaurants.
12. User indemnifies Club Apparel and its subsidiaries in the event the Product ordered by User does not meet User’s dietary or any other requirements and/or restrictions.
13. By ordering on Club Apparel Application User expresses the desire to enter into agreement with Club Apparel, its subsidiaries, and empaneled Partner Restaurants. User’s placing the Order does not construe acceptance of the Order.
14. The listing of Products on Club Apparel Application is not an offer to sell from Club Apparel, its subsidiaries, and empaneled Partner Restaurants. User’s placement of order on Club Apparel is an offer to purchase by the User from Partner Restaurants agreeing to all Terms & Conditions of usage of Club Apparel Application & Partner Restaurants including delivery timelines. Partner Restaurants’ acceptance of the Order will conclude the acceptance of offer to purchase made by User. Only after Partner Restaurants accept the Order, the sale would have concluded. Club Apparel, its subsidiaries and empaneled Partner Restaurants and Delivery Partners reserve the right to cancel any order without any reason whatsoever.
15. User has the option to place an order as a standard Delivery or a Scheduled Delivery. For a standard Delivery, we will tell the User an estimated delivery time while the User places the order, but we will attempt delivery as soon as possible; User agrees to be available at the delivery location to accept delivery from the time of placing the order. For a Scheduled Delivery, we will tell the time when the item is expected to be delivered; User must be available to accept delivery ten minutes before and ten minutes after that time.
16. User indemnifies Club Apparel, its subsidiaries or Partner Restaurants and Delivery Partners for any delays in delivery which occur due to circumstances which are not in control of Club Apparel, its subsidiaries or Partner Restaurants and Delivery Partners, circumstances such as, but not limited to, traffic and weather conditions, breakdown of delivery vehicle, accident, wrong address provided by user etc.
17. Club Apparel, its subsidiaries or Partner Restaurants and Delivery Partners will work to ensure all deliveries are made within the promised timeframe. However, if there are any delays due to unforeseen circumstances, we will inform the user and work with the User to conclude the delivery
18. User is responsible to provide correct Delivery information while placing the order. Delivery Partner will attempt delivery at the address provided by the User while placing the order. If Delivery Partner is not able to delivery successfully due to User’s action, then the User will be responsible for the loss of Order and will be charged accordingly for such failure. Within the framework of such a case, the User must accept all legal responsibilities arising from ordering a meal to an address where he/she does not exist. Reasons User might cause a delivery to fail include but are not limited to the following:
  • a. User does not come to the door to collect the order
  • b. User does not pick up the phone when the driver contacts the User using the contact information, they have provided us and/or User picked up the phone but then failed to provide access within a reasonable amount of time, and
  • c. The User unable to guide the driver to find a safe location to leave the food in absence of user.
19. During any product delivery made by the Delivery Partner, if User is not available in the address specified in the system, the order placed by the User shall not be delivered anywhere else. Within the framework of such a case, the User accepts all legal and financial responsibilities arising from ordering a meal to an address where User is not available.
20. In relation to any returns, the terms of product return belonging to the Partner Restaurants are applied. Club Apparel does not undertake any responsibilities for the disputes, which may arise from terms of product return belonging to the Partner Restaurants.
21. Delivery periods/Takeaway time quoted at the time of ordering are approximate only and may vary from Partner Restaurants / Locations.
22. User may be charged a delivery fee for delivery of order by the Partner Restaurant. User agrees that Club Apparel is authorized to collect, on behalf of the Partner Restaurant, the Delivery Charges for the delivery service provided by the Partner Restaurant. The Delivery Charges may vary from order to order, which may be determined on multiple factors which shall include but not be limited to Partner Restaurant, delivery area, order value etc. This will be notified to the User during the order process before User completes the order.
23. Delivery of an order placed by User through the Club Apparel Platform is undertaken directly by the Partner Restaurant. Club Apparel is merely providing a service to the User by acting as an intermediary between User, the Partner Restaurant and the Delivery Partner.
24. Please note that Club Apparel does not provide any delivery or logistics services and only enables the delivery of Products ordered by the Users through the Club Apparel Platform by connecting the Users with the Partner Restaurants.
25. Please note, Pickup/Takeaway would mean where a Partner Restaurant has agreed to provide an option to the Users to collect the Order themselves from the Partner Restaurant. The Pickup times for collection are provided by the Partner Restaurant and are only estimates.
26. When User opts for a Delivery/Pickup/Takeaway they agree to ensure compliance with the conditions governing the same, and Club Apparel shall not be liable in any manner in this regard. Club Apparel accepts no liability associated with food preparation by the Partner Restaurant, and all food preparation and hand over through Pickup/Delivery/Takeaway are the sole responsibility of the Partner Restaurant accepting the Order. The Delivery/ Pickup / Takeaway times are provided by the Partner Restaurant and are only estimates.
27. User agrees to adhere to all the local parking/ driving rules and regulations and is solely responsible for any violations there so while taking a curbside/kerbside/drive-thru pickup and indemnifies Club Apparel, its subsidiaries, Partner Restaurants for any fine/penalty/violations/ accidents done by the User while taking such delivery.
28. Club Apparel, its subsidiaries, Partner Restaurants and Delivery Partner reserves the right to cancel any order without any reason whatsoever. In case of cancellation, Club Apparel will notify the User that their order has been cancelled. User will not be charged for any orders cancelled by Club Apparel and/or the Partner Restaurant, and we will reimburse the User for any payment already made.
29. Prices include VAT and can also change at any time at the discretion of the Partner Restaurants. User will be notified of any applicable charges and taxes prior to purchase on the checkout page on our Application.
30. The final total price of User’s order will be displayed on the checkout page, including the prices of Items and Delivery and applicable Fees and taxes.
31. Payment for all Items and deliveries can be made on our Application by credit or debit card, or other payment methods made available by Club Apparel.
32. Once the User’s order has been confirmed the credit or debit card will be authorized and the total amount marked for payment. Payment is made directly to Club Apparel acting as agent on behalf of the Partner Restaurant only. Payment may also be made by using Coupons or E-Wallet credit. Use of these is subject to Club Apparel's Coupon and E-Wallet Credit Terms.
33. In an event where User has an issue with the order, User will first approach Club Apparel, its subsidiaries, Partner Restaurants to resolve the issues amicably.
34. If a User has an issue with Payment related matters, User will need to resolve those with User’s respective payment option provider. User must simultaneously inform Club Apparel, its subsidiaries, Partner Restaurants about any such issue that User is facing regarding orders placed on Club Apparel Application.
35. Credit or Debit cards used in placing order on Club Apparel App must belong to the user. Otherwise, the user must attain the legal permission from the card owner to perform the transactions.
36. All the orders placed on the App are currently pre-paid, User can choose to pay for their order using Debit/Credit Card while placing the order.
37. Club Apparel reserves the right to provide other payment methods or to no longer offer certain payment methods.
38. No replacement / refund / or any other resolution will be provided without Partner Restaurants’ consent.
39. Additional instructions / requests made by User while placing the Order will be attempted by the Partner Restaurant on a best effort basis. Club Apparel, its subsidiaries, Partner Restaurants will not be held accountable for not following these instructions partly or completely. Under any such circumstance User shall not be entitled for Refund.
40. All refunds shall be processed in the same manner as they are received, unless refunds have been provided to the User in the form of E-Wallet Credit, refund amount will reflect in User’s account based on respective banks policies.
41. The user refund procedure might take 7-14 working days to process on the Debit /Credit Cards bank payment gateway. The user has to follow up with the bank in case of any delay in crediting back the user’s account with the amount previously paid by the user.
42. All prices listed on the Club Apparel Platform are provided by the Partner Restaurant. The final price charged to the User by the Partner Restaurant may change at the time of delivery. In the event of a conflict between price on the Club Apparel Platform and price charged by the Partner Restaurant, the price charged by the Partner Restaurant shall be deemed to be the correct price.
43. Club Apparel at its discretion may make available from time to time: (i) Coupons (which are promotional credits that may be offered by us or by Partner Restaurants on our App) (ii) E-Wallet Credit (which is credit that may be applied to a user’s account at Club Apparel’s discretion) and (iii) Loyalty Points & Rewards. Coupons, E-Wallet Credits, Loyalty Points & Rewards operate as credits applying to a user’s Club Apparel account, redeemable (subject to conditions, as set out below) against the cost of Items. Coupons, E-Wallet Credits, Loyalty Points & Rewards are referred to collectively in these terms (the Credit Terms) as Credits.
44. These Credit Terms apply to the User’s use of any Credits to pay for Items using the Club Apparel Service. These Credit Terms apply together with the Club Apparel Terms and Conditions of Service, which continue to apply unless they conflict with these Credit Terms, in which case these Credit Terms have priority.
45. Item orders may be subject to minimum order values, which continue to apply regardless of whether payment or part-payment is by way of Coupons, E-Wallet Credits, Points and Rewards, these cannot be exchanged for cash or any other alternatives and have no monetary value.
46. By placing an order on Club Apparel Application, User agrees to all terms & conditions including privacy policy of Club Apparel App including Club Apparel sharing user’s details with its subsidiaries, Partner Restaurants, Delivery Partners, platform service providers, marketing service providers etc. in order to a seamless experience to the User and complete the delivery of the Order. User indemnifies Club Apparel its subsidiaries, Partner Restaurants, Delivery Partners, platform service providers, marketing service providers etc. for any usage of User’s details by these entities to provide seamless experience to User at the time of the Order and subsequently thereof to provide User with information on new offers/products/features/restaurants/brands etc. to enhance the User’s overall experience with Club Apparel Application. Club Apparel its subsidiaries, Partner Restaurants, Delivery Partners, platform service providers, marketing service providers etc. reserves the right to analyze, interpret, use User generated data both personal and generic to create a better experience on Club Apparel platform.
47. To connect Users to certain Partner Restaurants, the Restaurants’ contact details may be displayed on the specific Partner Restaurant listing page on the Club Apparel App, which connect Users directly to the Partner Restaurants' phone lines. Please note that the Partner Restaurant may record all information regarding this call including the voice recording of the conversation between the User, and the Partner Restaurant (for internal billing tracking purposes and customer service improvement at the restaurant's end). Users explicitly agree and permit the Partner Restaurant to record all this information when they avail the telephony services. If the User does not wish that their information be recorded in such a manner, they are advised not to use the telephone services provided by Club Apparel.
48. Club Apparel is not liable for any information that may have become outdated since the last time the information was updated. Club Apparel reserves the right to make changes and corrections to any part of the Content on the App at any time without prior notice. Club Apparel does not guarantee quality of the Products, the prices listed in menu or the availability of items listed in the menu at any Partner Restaurant.
49. All pictures and information contained on the App are owned by or licensed to Club Apparel. No other party is authorized to reproduce or republish these in any format whatsoever without the prior written permission of Club Apparel.
50. Club Apparel reserves the right to suspend/discontinue any or all products without notice, make modifications and alterations in any or all its contents, products and services contained on the App
51. Club Apparel is not a manufacturer, seller or distributor of Products and merely places an order against the Partner Restaurant(s) on User’s behalf and facilitates the sale and purchase of Products between the User and Partner Restaurant(s).
52. Club Apparel shall not be liable for Partner Restaurant’s quality of service, wrong delivery of order, order mismatch, poor quality, incorrect pricing, deficient quantity, time taken to prepare or deliver the order, etc.
53. Club Apparel shall not be liable for any direct, indirect, special or consequential losses or damages from the use or inability to use this App. Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence.
54. User agrees to indemnify and hold Club Apparel, its parents, subsidiaries or employees harmless from any claim, demand, or damage, including attorneys' fees, made by anyone in connection with the User’s use of the App, with any alleged infringement of intellectual property or other right of any person or entity relating to the site, User’s violation of these Terms of Use, and any other acts or omissions relating to the site.

By registering on the Club Apparel Mobile App, you accept the Terms & Conditions of Club Apparel - the Loyalty program of Major Brands and its Partners. Major Brands reserves the right to amend, cancel or change the Terms & Conditions or suspend the loyalty program at any time without any notice and Major Brands has the sole discretion on the same. The Terms & Conditions of Club Apparel Loyalty program herein referred to as "Club Apparel" are listed below.
1. The Club Apparel membership commences when the customer registers into the program using the mobile application validating the account with One Time Password and providing the Date of Birth along with setting up the password
2. The membership is valid for a period of one (1) year from the date of joining the program. At least one purchase in a year is a prerequisite for successive renewal of membership
3. Major Brands reserves the right to terminate any membership without any notice at its sole discretion. Any discontinuance of membership does not limit Major Brands’ right to use information / data collected on members during the term of membership
4. This program is applicable across all approved participating retail stores of the Major Brands and its partners in India
5. Only one (1) membership per GSM phone number
6. The membership is non-transferable and can only be used by the authenticated / validated member. Customer needs to complete successful OTP validation on the registered number to complete authentication
7. Membership charges and term of membership, if any, will be decided by Major Brands at its sole discretion
8. Club Apparel members are entitled to earn points on purchase of any regular priced merchandise, or what is otherwise announced by Major Brands
9. Points accrued in any of the approved participating retail stores of the Major Brands and its partners in India can only be redeemed in approved participating retail stores of the Major Brands and its partners in India
10. Points accrued in any of the approved participating retail stores of the Major Brands and its partners in India cannot be redeemed in any other country
11. Points accrued in any of the approved participating retail stores of the Major Brands and its partners in any other country apart from India cannot be redeemed in any of the approved participating retail stores of the Major Brands and its partners in India and vice versa
12. A valid point is equivalent to one (1) INR
13. Points can only be earned / redeemed through the Mobile App only. To redeem points, customer must complete their profile on the Club Apparel Mobile App
14. CA Points are valid for redemption within one year from the date of purchase
15. Brand Points validity is decided by Club Apparel while rewarding the points; the point’s expiry date can be checked on mobile app
16. Points earning structure may vary from brand to brand and format to format. For latest point earned structure kindly refer the Club Apparel Mobile App
17. Points earned on full priced products versus sale / promotion products may vary
18. Members can earn points while redeeming Gift Cards. Points are not issued upon purchase of Gift Card
19. Points are issued on the Nett tendered amount in Cash / Credit Card / Debit Card / Other payment modes excluding the GST amount. Example, points are not issued on promotional gift vouchers amount
20. Major Brands may at any time reject to reward or redeem points for failure to pay for the purchases or for any breach of these conditions or for any judicious reason and the member shall have no right to claim the points
21. Points cannot be transferred between member accounts. However, a member can change the number by editing the number on the mobile app and re-validating the same
22. Points can never be exchanged or transferred to cash but can only be claimed against purchases in Club Apparel participating stores in India
23. Major Brands will deduct points at the time of refund if any awarded-on purchase
24. All points belong to Major Brands and may never be exchanged for goods not approved by Major Brands
25. Membership rights are reserved with Major Brands and are subject to Major Brands’ approval. A membership can be terminated in the event of a member failing to comply with these Terms & Conditions or Supplying any false or misleading information to Major Brands or abusing any membership privileges or not using membership for a period of 12 months or in case of death of a member or becoming bankrupt or under discretion of Major Brands for judicious reasons
26. A member may cancel his / her membership by giving Major Brands written cancellation request through email at clubapparel@appareluae.com
27. In case of such termination Major Brands shall be responsible to the member only to the extent of the points lying to the credit of the member's account
28. Major Brands shall not be responsible whatsoever for any data loss, or corruption of data or its confidentiality or the likes of the customer. No claim of whatever nature in this regard, shall lie against Major Brands either by the customer or a third party
29. Major Brands also does not take responsibility for any lost points / discrepancy of points earned or any claim for damage to a mobile phone as a consequence of a Club Apparel membership
30. Major Brands shall not be held liable for any loss, theft, damage or unauthorized use of the mobile phones/membership/mobile app account and it is the sole responsibility of the member to ensure safety of his mobile phone, mobile app account and/or the password if any allotted to him for the purpose
31. Any loss of mobile or sim card should be intimated to Major Brands immediately failing which member is liable for loss of points and will not hold Major Brands for any loss occurring due to such events
32. All conditions and warranties, whether expressed or implied and whether arising under legislation or otherwise, as to condition, suitability, quality, fitness or safety of any reward supplied are expressly excluded to the full extent permitted by law. Any liability that cannot be fully excluded is limited, where permitted, to replacing, or crediting the value of the Loyalty points at our discretion
33. Major Brands shall not be responsible in any way for technical faults by third parties and service provider as they are beyond the control of Major Brands. Major Brands shall at the best shall endeavor to sort out the said problem

4. Club Apparel Points can be redeemed at Tim Hortons stores
5. Members will get stamps on redemption of Club Apparel points
6. Earned Reward Beverages will be Valid for 3 months
7. Add-Ons are NOT included with the redeemed Beverage
8. The reward Beverage can be redeemed at Club Apparel Tim Hortons stores in UAE, Oman, Qatar Bahrain & KSA
9. Stamps are Not Collected for a redeemed Beverage
10. Reward Beverage cannot be upsized or changed to any other products
